2. Prices and Payment

On our B2B website prices are shown in Euro, USD, or SEK depending on the country where you are located. All prices are excluding VAT. We accept payment by credit card, Paypal as well as invoice. We do not charge any credit card fees. The amount of the order will only be captured when your order has been shipped just as an invoice only is generated once your order has been shipped.

3. Delivery

In order to offer the cheapest and most secure shipping for all order sizes (packets as well as pallets), we work with various courier companies. The shipping price will depend on which country you order from and you will be able to see the shipping prices of your country when you are logged in to our B2B website.

4. Responsibility

Martin Schwartz ApS is striving to ship all orders within three working days but from time to time, delays may occur. The buyer can always cancel their order if the order has not yet been dispatched. However, Martin Schwartz ApS is not obliged to deliver goods which are sold out from the warehouse. Martin Schwartz ApS is also not responsible for delays or non-performance of contract caused by force majeure. As long as a force majeure situation is in place Martin Schwartz ApS will bear no responsibility. The liability of Martin Schwartz ApS’ is by any kind of claim limited to the price of the product. Martin Schwartz ApS is offering a purchase liability to the buyer according to the Danish Sales of Goods Act.

5. Right of Return

A purchase at Martin Schwartz ApS is a binding agreement and under normal circumstances your purchase cannot be regretted.

6. Right of Complaint

Besides these Terms and Conditions, the Danish Sales of Goods Act will apply. That means that within 24 months of the purchase the buyer has a right of complaint. Please contact Martin Schwartz ApS before returning the good in question. If the complaint is accepted the buyer can have the product repaired, exchanged, refunded or obtain a discount depending on the situation.

The buyer has to complain within a ’reasonable time’ after the fault of the product has been discovered. If the complaint takes place within two months from the discovery of the fault it will always be considered reasonable time.
If the complaint is accepted, we will refund (within reason) delivery costs as well. Please be aware that the product has to be returned in good shape and please also remember to send us the receipt of the waybill so your costs can be reimbursed.

7. Right of Withdrawal

Right of Withdrawal is only for private customers and is not offered to wholesale customers at martinschwartz.com.

8. Data Privacy Policy

To be able to supply our products to you we need the following information:
Name, Address, company registration number, telephone and email-address.
We are registering and will share the data which is necessary in order to be able to deliver the product to you. The data is registered by Martin Schwartz ApS and is stored for five years. We also work together with a number of other companies which store and process data. The companies only process the data on our behalf and are not allowed to use the data for their own purposes. We only work with data processors within the EU or in countries which are able to protect your data adequately.

You have the right to know which information we store on you. If you think that the information is not correct you are entitled to have it altered. In some cases, we will have to delete your data if you ask us to. That could for instance be the case if your data no longer is necessary in relation to the purpose which it was originally needed for.
